5. Suing Your Attorney

In most instances, it is economically impractical for you to sue your attorney. The amount of damages caused most frequently by attorneys is below $100,000. So there is no remedy for a client because it will cost between $100,000 and $200,000 just to get your case to a jury. If you have damages greater than $200,000, you should have a professional evaluate the validity of your claims.

To evaluate whether it is practical to hire a new attorney to sue your former attorney, you should carefully consider four questions:

What is the economic value of the damages caused by your attorney?
Does your attorney have insurance?
Do you have a valid legal claim, that is, will your state's statutes and common law recognize the wrongs of your attorney?
What defenses to your claim might your attorney raise?
